Dubai Courts
strives to achieve the satisfaction of the public through maintaining an up-to-date level in technology, in order to provide speedy justice for the welfare of the society.
The Dubai Courts also provide electronic services in such a way that enables the parties of legal cases to view the details of their cases and follow up their progress.
The court structure in Dubai is comprised of the following courts: the Court of First Instance, the Court of Appeal and the Court of Cassation. The Court of First Instance includes the Civil Court, the Criminal Court and the Sharia Court.
The Court has been divided into four groups of Circuits, restricted and full jurisdictions, according to the value of the right, from the civil side, and the volume of crimes against society, from the criminal side.
The Courts of Dubai in its historical development have undergone a series of reforms that are in short a necessary and unavoidable respond to the requirements of the present and expectations of the future.
Main Mission of Dubai Court is implementation of justice in the society, through precision and promptness in adjudicating lawsuits, execution of judgments, decisions, judicial orders, contract and document authentication, by relying on qualified national cadres and regulations, procedures, and new developed technology.
About Courts
According to the legal system adopted in the countries, courts are divided into three stages of litigation. The three stages are as follows:
- The court of first Instance
- The court of Appeal
- The court of Cassation
First Instance
The court of first instance is the first stage in judicial process. The court of first instance is the process which deals with the judiciary in order to claim the right or to obtain the one of the services performed by the court regardless of the type of right or service claimed.
The Court of Appeal
The court of appeal is the second stage in the judicial process. This stage resorts the judicial process to contest the decisions of the court of First Instance through filing an appeal with the Court of Appeal.
The Court of Cassation
The Court of Cassation is the third stage in the judicial process to which resort those who challenge the decision of the court of appeal by filing a further appeal against the judgment of the court of appeal in case the value of the claim is in excess of 200,000 Dirham or is undetermined at the time of filing the appeal.
With reference to the three stages of litigation, Courts of Dubai were not at first formed by one single law, but by successive ones. The first, was issued on September 8, 1970 concerning the establishment of Dubai Courts, the designation of the chief justice and dividing the courts to civil and religious courts. It specified two stages of litigation: the court of first instance and the court of appeal. Law no. 2 of year 1979 was issued establishing the higher court of appeal, followed by Law no. 1 of 1988 constituting the Court of Cassation. This situation continued until the issuance of the Law organizing the courts in Dubai, law no.3 of year 1992, grouping the three courts in one legislation and providing that the courts are composed of three: Cassation, Appeal and the court of first instance. This law was referred to in law no. 1 of year 2003, concerning the establishment of the Department of Justice, providing in article 9 that the courts shall be regulated pursuant to the Law organizing the courts, issued in 1992, thus emphasizing that the said law, organizing the Courts, is still in effect. This means that Law no. 1 of year 2003 has attached the courts of Dubai to the Department of Justice as concerns the regulation of their financial and administrative affairs, as provided in article 4, and left to the Law organizing the Courts of year 1992 the jurisdiction of organizing the judicial affairs of the Courts, under the administration of the Department of Justice in the Dubai Emirate.
